These Terms of Use (“Terms”) govern your access to and use of the WhoIsMyHOA website, applications, features, communications, and related services collectively referred to as the “Service.”
The Service is operated by the owner of WhoIsMyHOA, referred to in these Terms as “WhoIsMyHOA,” “we,” “us,” or “our.”
Please read these Terms carefully. By accessing or using the Service, creating an account, or submitting information or content, you agree to be bound by these Terms and acknowledge our Privacy Policy. If you do not agree to these Terms, do not use the Service.
1. About the Service
WhoIsMyHOA provides a platform through which users may search for and view information relating to properties, condominium associations, homeowners’ associations, condominium trusts, property managers, management companies, and related entities.
The Service may also allow users to:
- Submit corrections or additions to property information;
- Post reviews, ratings, comments, or other descriptions of their experiences;
- Upload documents or other supporting materials;
- Verify a connection to a property;
- Report inaccurate, unlawful, or inappropriate content;
- Respond to or request review of published information; and
- Use other features that we may introduce.
Information available through the Service may come from users, publicly available records, third-party sources, property managers, associations, automated systems, or our own research and processing.
2. Informational Service Only
The Service is provided for general informational purposes.
WhoIsMyHOA is not a law firm, real-estate brokerage, property-management company, condominium association, homeowners’ association, engineering firm, accounting firm, financial adviser, insurance adviser, or government agency.
Nothing on the Service constitutes legal, financial, tax, investment, insurance, engineering, real-estate, property-management, or other professional advice.
You should not rely on the Service as a substitute for:
- Reviewing official association documents;
- Obtaining resale certificates, questionnaires, budgets, meeting minutes, financial statements, master deeds, declarations, bylaws, rules, insurance documents, inspection reports, or other governing records;
- Contacting the relevant association, property manager, government agency, or records office;
- Conducting an inspection or title review;
- Consulting an attorney, accountant, broker, inspector, lender, insurer, engineer, or other qualified professional; or
- Performing your own due diligence before purchasing, selling, leasing, financing, or otherwise dealing with property.
You are solely responsible for independently verifying information that may affect a legal, financial, housing, or purchasing decision.
3. No Guarantee of Accuracy or Completeness
Property, association, management-company, review, rating, and other information available through the Service may be incomplete, inaccurate, outdated, disputed, or associated with the wrong property or organization.
Public records and third-party data may contain errors. Association names, management arrangements, addresses, fees, rules, and other information may change without notice. User submissions may reflect individual experiences, interpretations, or opinions that cannot be independently verified.
We do not represent or warrant that:
- Any property has been correctly matched with an association or manager;
- Any association or management company is currently responsible for a listed property;
- Any fee, assessment, policy, rule, contact detail, or other fact is current;
- Reviews are representative of all residents or transactions;
- A verified user’s submission is necessarily accurate;
- A document is complete, authentic, legally operative, or current; or
- Errors will be identified or corrected within any particular period.
Verification badges, confidence indicators, source descriptions, moderation decisions, and similar labels indicate only that specified checks or processes may have occurred. They are not guarantees of truth, authenticity, authority, or completeness.
4. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account or submit content.
You agree to provide accurate and current account information and to update it when necessary. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.
You may not:
- Create an account using another person’s identity without authorization;
- Misrepresent your role, identity, property connection, professional status, or organizational affiliation;
- Create multiple accounts to evade restrictions or manipulate the Service;
- Share verification codes or allow another person to use your account improperly; or
- Use automated means to create accounts or submit content.
Notify us promptly through the Contact page if you believe your account has been accessed without authorization.
We may reject, restrict, suspend, or terminate an account when reasonably necessary to protect the Service, its users, or third parties, or to enforce these Terms.
5. User Submissions
“User Submissions” means information or material that you submit, post, upload, transmit, or otherwise provide through the Service. This includes reviews, ratings, corrections, comments, responses, reports, photographs, documents, property information, verification materials, and communications.
You retain any ownership rights you may have in your User Submissions.
By providing a User Submission, you grant WhoIsMyHOA a worldwide, nonexclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, format, adapt, analyze, moderate, translate, summarize, publish, display, distribute, and otherwise use the submission as reasonably necessary to:
- Operate and improve the Service;
- Display information to users;
- Evaluate, verify, or moderate submissions;
- Create summaries, classifications, confidence indicators, or aggregate information;
- Investigate reports or disputes;
- Prevent fraud, abuse, and security incidents;
- Comply with legal obligations; and
- Promote the Service using anonymized or appropriately attributed excerpts.
This license continues for as long as reasonably necessary to operate the Service, maintain records, resolve disputes, enforce agreements, comply with law, and preserve the integrity of previously published discussions or decisions.
Removing a submission or deleting an account may not immediately or completely remove copies from backups, audit records, legal-preservation systems, or materials previously shared with others.
You represent and warrant that:
- You have the right to provide the submission;
- The submission does not violate these Terms or applicable law;
- The submission is not knowingly false, fabricated, misleading, or materially incomplete;
- You have permission to upload any document or material belonging to another person or organization; and
- Our permitted use of the submission will not infringe another person’s rights.
6. Reviews, Ratings, and Comments
Reviews and ratings must reflect genuine experiences, observations, or interactions.
When submitting a review, rating, or comment, you agree that you will not:
- Submit a fabricated review or describe an experience that did not occur;
- Impersonate another person;
- Misrepresent your relationship to a property, association, manager, vendor, or reviewed organization;
- Coordinate submissions intended to artificially raise or lower a rating;
- Submit duplicate reviews through multiple accounts;
- Offer, accept, or request payment, benefits, threats, or pressure in exchange for a particular review or rating;
- Post content primarily to harass, retaliate against, extort, or intimidate another person;
- Present speculation, rumor, or opinion as an established fact;
- Knowingly make a false allegation of fraud, theft, discrimination, criminal conduct, professional misconduct, or other serious wrongdoing;
- Disclose unnecessary private or identifying information;
- Publish confidential communications or restricted documents without authorization; or
- Use the review system for advertising, solicitation, or unrelated disputes.
You should describe what occurred, identify relevant dates or circumstances when appropriate, distinguish facts from opinions, and avoid conclusions that you cannot substantiate.
A review does not need to be positive. We do not require users to change or remove truthful criticism merely because an association, manager, or other person disagrees with it.
Associations, managers, and other affected parties may be permitted to respond to reviews or report content for further review. A response or report does not guarantee removal or modification.
7. Property Corrections and Factual Submissions
When submitting a property correction or other factual information, you agree to provide information that you reasonably believe is accurate.
Where possible, you should identify the source, effective date, and scope of the information. You should not submit guesses as confirmed facts.
We may:
- Compare a submission with public records or other submissions;
- Request supporting information;
- Ask additional users to confirm a proposed correction;
- Refer a submission for administrative review;
- Display the submission as pending, disputed, unverified, or community-reported;
- Accept only part of a submission;
- Reverse or revise an earlier decision; or
- Decline to publish a submission.
Our acceptance or publication of a correction does not mean that we guarantee its accuracy.
8. Documents and Verification Materials
You may be permitted to upload documents to support a correction, verify a connection to a property, or assist with moderation.
Before uploading a document, remove or redact information that is not necessary for the stated purpose, including:
- Social Security numbers;
- Bank or payment-card information;
- Account credentials;
- Medical information;
- Government identification numbers;
- Signatures when not needed;
- Information about children;
- Unrelated names, email addresses, telephone numbers, or mailing addresses; and
- Other sensitive or confidential information.
Do not upload documents that you obtained unlawfully or that you are prohibited from sharing.
Submitting a document does not guarantee that it will be accepted, relied upon, published, or permanently retained. We may restrict access to uploaded documents, extract limited information from them, reject them, redact them, or delete them in accordance with our operational and legal requirements.
Unless a feature expressly states otherwise, uploading a document does not mean that the full document will be displayed publicly.
9. Prohibited Conduct
You may not use the Service to:
- Violate any applicable law or another person’s rights;
- Defame, threaten, harass, stalk, or intimidate another person;
- Discriminate against or target another person based on a legally protected characteristic;
- Publish another person’s sensitive personal information without a legitimate reason and proper authorization;
- Submit fraudulent, deceptive, or manipulated content;
- Interfere with another user’s ability to use the Service;
- Circumvent account, verification, moderation, rate-limit, or security controls;
- Scrape, crawl, harvest, download, or systematically copy the Service except as expressly permitted by us or by applicable law;
- Use bots or automated systems to create accounts, submit content, vote, rate, report, or interact with the Service without written authorization;
- Probe, scan, or test the vulnerability of the Service;
- Introduce malware or harmful code;
- Attempt to access accounts, databases, systems, or information without authorization;
- Use information from the Service to facilitate harassment, discrimination, unlawful surveillance, identity theft, or fraud;
- Resell, republish, or commercially exploit substantial portions of the Service without authorization;
- Falsely imply that you are affiliated with, endorsed by, or acting for WhoIsMyHOA;
- Remove copyright, trademark, attribution, or proprietary notices; or
- Assist another person in doing any of the above.
Reasonable use of public information for personal research, ordinary property due diligence, and linking to public pages is permitted, subject to these Terms.
10. Moderation and Enforcement
We may, but are not obligated to, review, screen, investigate, verify, edit, restrict, label, decline, remove, preserve, or restore content.
Moderation may involve automated systems, human review, information supplied by users, supporting documentation, public records, and third-party services.
Moderation is intended to support the usefulness and safety of the Service. It is not a determination by a court, regulator, professional investigator, or fact finder.
We may take action when we reasonably believe content:
- Violates these Terms;
- May be unlawful;
- Presents a safety, privacy, fraud, or security risk;
- Is irrelevant, duplicative, promotional, or abusive;
- Cannot be meaningfully verified;
- Is subject to a credible dispute;
- Exposes sensitive information;
- Creates legal or operational risk; or
- Otherwise undermines the integrity of the Service.
We are not required to explain every moderation decision. We may provide a reporting or appeal process, but submission of an appeal does not guarantee reconsideration, restoration, or a response within a particular period.
Our decision not to remove content does not constitute an endorsement of that content.
11. Reports, Claims, and Requests for Correction
If you believe content is inaccurate, unlawful, infringes your rights, or violates these Terms, you may submit a report through our Contact page.
A report should identify:
- The specific page or content at issue;
- The reason for the report;
- The correction or action requested;
- Your relationship to the property or organization, when relevant; and
- Supporting information sufficient for us to evaluate the request.
Submitting a report does not guarantee removal, modification, disclosure of user information, or any particular outcome.
We may share the substance of a report with the person who submitted the disputed content when reasonably necessary to evaluate the dispute, but we will handle personal information in accordance with our Privacy Policy and applicable law.
Associations, management companies, and other organizations may be permitted to claim or verify a profile. Verification confirms only that specified identity or authorization checks were completed. It does not give the verified party ownership of the public page, control over user reviews, or a right to remove criticism.
12. Intellectual Property
The Service, including its software, design, interfaces, organization, branding, original text, graphics, databases, compilations, and other materials, is owned by or licensed to WhoIsMyHOA and is protected by applicable intellectual-property laws.
These Terms grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Service for lawful personal or internal business purposes.
“WhoIsMyHOA,” our logos, and related branding may not be used without prior written permission.
Third-party names, trademarks, and logos appearing on the Service belong to their respective owners. Their appearance does not imply sponsorship, endorsement, or affiliation.
13. Copyright Complaints
If you believe material on the Service infringes your copyright, please contact us through the Contact Us page:
Your notice should include the information required by applicable law, including identification of the copyrighted work, identification of the allegedly infringing material, your contact information, a statement of good-faith belief, a statement under penalty of perjury regarding the accuracy of the notice and your authority to act, and your physical or electronic signature.
We may remove or restrict access to material in response to a valid complaint and may terminate accounts of repeat infringers where appropriate.
This section should be reviewed and completed before relying on it as a formal Digital Millennium Copyright Act process.
14. Third-Party Services and Links
The Service may contain links to third-party websites, public-record systems, management-company sites, association sites, mapping services, government resources, or other services.
We do not control and are not responsible for third-party services, their availability, accuracy, security, content, or privacy practices. A link or reference does not imply that we endorse or are affiliated with the third party.
Your use of a third-party service is governed by that service’s own terms and policies.
15. Privacy
Our collection and use of personal information are described in our Privacy Policy.
You agree not to submit personal information about another person unless you have a lawful and legitimate basis to do so.
You should not assume that information submitted through public review, correction, response, or comment fields will remain private. Information submitted through verification, reporting, or support workflows may receive different treatment as described in the relevant interface and Privacy Policy.
16. Service Availability and Changes
We may modify, suspend, restrict, or discontinue any part of the Service at any time.
We do not guarantee that:
- The Service will always be available;
- Access will be uninterrupted or error-free;
- Stored content will never be lost;
- A particular feature will continue to exist;
- Every report or submission will be reviewed; or
- The Service will be compatible with every device or browser.
We may establish or change submission limits, storage limits, eligibility rules, verification requirements, or other operational restrictions.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”
WHOISMYHOA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND COURSE OF DEALING OR USAGE.
WE DO NOT WARRANT THAT THE SERVICE OR ANY INFORMATION AVAILABLE THROUGH IT WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, AVAILABLE, OR SUITABLE FOR YOUR PURPOSES.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHOISMYHOA AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, HOUSING OPPORTUNITY, BUSINESS OPPORTUNITY, OR PROPERTY VALUE ARISING FROM OR RELATING TO:
- YOUR USE OF OR INABILITY TO USE THE SERVICE;
- RELIANCE ON INFORMATION AVAILABLE THROUGH THE SERVICE;
- USER SUBMISSIONS OR THIRD-PARTY CONTENT;
- PROPERTY, ASSOCIATION, OR MANAGEMENT INFORMATION;
- MODERATION, VERIFICATION, PUBLICATION, OR REMOVAL DECISIONS;
- UNAUTHORIZED ACCESS TO OR ALTERATION OF INFORMATION; OR
- DEALINGS WITH AN ASSOCIATION, MANAGER, PROPERTY OWNER, TENANT, BROKER, VENDOR, OR OTHER THIRD PARTY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED:
- THE AMOUNT YOU PAID DIRECTLY TO WHOISMYHOA FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM;
These limitations apply regardless of the legal theory asserted and even if we were advised that damages were possible.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
19. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless WhoIsMyHOA and its owners, officers, directors, employees, contractors, agents, affiliates, licensors, and service providers from claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising from or relating to:
- Your User Submissions;
- Your violation of these Terms;
- Your misuse of the Service;
- Your violation of applicable law; or
- Your infringement or violation of another person’s rights.
WhoIsMyHOA may assume control of the defense of a matter subject to indemnification, and you agree to reasonably cooperate.
This provision should be reviewed by counsel, particularly before applying it to consumers.
20. Suspension and Termination
You may stop using the Service at any time.
We may restrict, suspend, or terminate your access if we reasonably believe that:
- You violated these Terms;
- Your activity creates legal, security, fraud, privacy, or safety risk;
- Your account is being used without authorization;
- Suspension is necessary to comply with law or a valid legal request; or
- Continuing to provide access is no longer operationally reasonable.
Termination does not eliminate obligations or rights that arose before termination.
Sections concerning licenses, intellectual property, disclaimers, limitations of liability, indemnification, disputes, and other provisions that by their nature should survive will remain effective after termination.
22. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the “Last updated” date and provide any additional notice required by law. Material changes may be communicated through the Service, by email, or through another reasonable method.
Changes will apply prospectively from the effective date stated in the updated Terms.
If we request renewed acceptance because of a material change, you may need to accept the updated Terms before continuing to use certain account or submission features.
23. Electronic Communications
When you create an account, submit a form, or communicate with us electronically, you consent to receive communications from us electronically regarding your account, submissions, verification requests, moderation matters, reports, security issues, and changes to the Service.
You are responsible for keeping your email address current.
Marketing communications, if any, will be handled separately and may be subject to additional consent and opt-out rights.
24. General Provisions
These Terms, together with the Privacy Policy and any additional terms presented for a particular feature, constitute the entire agreement between you and WhoIsMyHOA concerning the Service.
If a provision is found unenforceable, it will be modified only to the extent necessary or severed, and the remaining provisions will continue in effect.
Our failure to enforce a provision is not a waiver of our right to enforce it later.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or transfer of the Service.
Headings are provided for convenience and do not affect interpretation.
Nothing in these Terms creates an employment, agency, partnership, joint-venture, fiduciary, brokerage, or professional-adviser relationship between you and WhoIsMyHOA.
